Indonesia, the Federation of Malaya and the Philippines agreed that North Borneo’s inclusion in Malaysia would not prejudice the Philippine claim or any rights under it.

Malaysia’s formation and an unresolved claim

The Accord was concluded while Malaysia’s formation was being negotiated. Paragraph 12 addressed what inclusion of North Borneo would mean for the Philippine claim. Its preservation clause explains why a change in political administration did not, by agreement among these parties, dispose of that claim.

Why this record matters

The Accord separates the formation of Malaysia from disposal of the claim. Paragraph 12 preserves the pursuit of a peaceful settlement without determining which state holds title.
